2) O1 근로비자(O1 work visas)

가) 개념

특출한 능력을 가진 분야에서 일하는 외국인(Alien working in area of extraordinary ability)을 위한 비자입니다. 베컴(Beckham)과 유현진과 같은 경우가 이에 해당합니다.

INA 101(a)(15)(O)(1)는 다음과 같이 상세히 이 유형에 대해 정의하고 있습니다.



1. 외국인으로서, 과학, 예술, 교육, 사업 또는 체육분야에서 특출한 능력을 가진 자로서(has extraordinary ability in the sciences, arts, education, business, or athletics) ,

2. 그러한 능력이 국내 또는 국제적 수상경력에 의해 증명된 자, 또는 영화 티브이 제작과 관련하여서는 특출한 성과에 대해 과시된 기록에 의해 소명되고, 그러한 성과가 광범위한 자료에 의해 그 분야에서 인정된 자로서(which has been demonstrated by sustained national or international acclaim or, with regard to motion picture and television productions a demonstrated record of extraordinary achievement and whose achievements have been recognized in the field through extensive documentation,),

3. 그러한 특출한 능력의 분야에서 계속 일하고자 미국에 입국을 구하는 경우(seeks to enter the United States to continue work in the area of extraordinary ability); ”


O1 비이민비자는 과학, 예술, 교육, 사업, 또는 체육분야의 특출한 능력을 가지거나, 영화나 방송산업에서 특출한 성과를 보여준 이력이 있고 전국적으로나 세계적으로 그러한 성과를 가진 것으로 공인된 사람을 위한 것입니다(The O-1 nonimmigrant visa is for the individual who possesses extraordinary ability in the sciences, arts, education, business, or athletics, or who has a demonstrated record of extraordinary achievement in the motion picture or television industry and has been recognized nationally or internationally for those achievements).


나) O1 비자 적격 기준

O1 비자를 신청하기 위해서는, 수혜자는 반드시 특출한 능력을 가지고 있음을 국가적 또는 국제적인 수상을 받은 사실을 통해 소명해야 하며, 특출한 능력 분야에서 업무를 계속하기 위해 미국에 일시적으로 입국하는 경우라야 합니다(To qualify for an O-1 visa, the beneficiary must demonstrate extraordinary ability by sustained national or international acclaim and must be coming temporarily to the United States to continue work in the area of extraordinary ability).

과학, 교육, 사업 또는 체육분야에서의 특출한 능력이란 그자가 노력한 분야의 매우 높은 수준에 도달한 소수에 해당하는 것을 밝혀주는 숙련된 수준을 말합니다((Extraordinary ability in the fields of science, education, business or athletics means a level of expertise indicating that the person is one of the small percentage who has risen to the very top of the field of endeavor).

예술 분야에서의 특출한 능력이란 차별성을 말합니다((Extraordinary ability in the field of arts means distinction). 차별성이란 예술 분야에서의 매우 높은 수준의 성과를 말하며, 예술분야에서 통상의 정도를 상당히 뛰어 넘어 뛰어난 것으로 묘사된 사람이 유명하고, 선도적이거나 잘 알려진 정도로 숙련된 정도와 인정받은 것에 의해 증명되는 것을 말합니다(Distinction means a high level of achievement in the field of the arts evidenced by a degree of skill and recognition substantially above that ordinarily encountered to the extent that a person described as prominent is renowned, leading, or well-known in the field of arts).

영화와 방송산업분야에서 O1 비자 적격을 구비하기 위해서는, 수혜자는 영화나 방송분야에서 탁월하고, 주목받는, 주도적인 자라는 정도로 매우 통상적이지 않은 수준의 능력과 인정을 받았다는 증거에 의해 탁월한 성과를 달성한 것을 소명해야 합니다((To qualify for an O-1 visa in the motion picture or television industry, the beneficiary must demonstrate extraordinary achievement evidenced by a degree of skill and recognition significantly above that ordinarily encountered to the extent the person is recognized as outstanding, notable or leading in the motion picture and/or television field).

다) O1 비자 신청과정(Application Process O-1 Visa)

청원자는 USCIS 사무소에 I-129 양식을 통해 비이민자 근로자를 위한 청원을 제출해야 합니다(The petitioner should file Form I-129, Petition for Nonimmigrant Worker).

청원은 외국인의 서비스에 대한 실제 필요가 있는 때로부터 소급하여 1년이상 이전에는 제출되어서는 안됩니다(The petition may not be filed more than one year before the actual need for the alien's services).
절차지연을 피하기 위해 I-129 양식은 고용일로부터 최소한 45일 이전에는 제출되어야 합니다(To avoid delays, the Form I-129 should be filed at least 45 days before the date of employment). 결국 고용하고자 하는 날로부터 소급하여 1년 내지 45일 사이에 신청서를 제출해야 합니다.
